TERMS OF PURCHASE

The following terms (the “Agreement” or “Contract”) shall be effective upon execution of the purchase process by you (“Client” or “You”).

WEDDING PURCHASE: Your Agreement/Contract with Beach Wedding Deals, LLC (BWD) will last for the term (the “Term”) specified for your upcoming wedding. NO TANGIBLE PERSONAL PROPERTY IS TRANSFERRED TO THE CLIENT IN THIS CONTRACT.

CANCELLATION/REBOOKING: The 25% retainer plus any fees spent on your behalf for items and/or services associated with your wedding are non-refundable. We do not hold your date without the retainer. The remaining balance is due 7-days before the date. Upon written request, BWD can postpone the wedding once, moving the date/time/location out for up to 1 year without additional cost (except for permits or vendor deposits). Cancellation within 7-days of the original booked date is prohibited making the total amount paid non-refundable. If a cancellation is made within the 7-days, the client agrees to hold harmless and release all further financial, legal, reviews, chargebacks, PayPal or Square disputes, of Beach Wedding Deals and its associates of all further obligations.

UPGRADING: The client may upgrade by adding additional products and/or services by contacting Beach Wedding Deals by phone or email. Upgrades to existing products and services will be regarded as a New Agreement and must be in writing (email) before any changes are finalized.

DECORATIONS: BWD does not allow the client to set up their own arbor, chairs, or tiki's. BWD provides those services with our wedding packages. BWD will allow the client to set up small decorations such as signs, flowers, candles, etc. No independent vendor will be allowed to set up decorations with our packages. If the client hires an independent vendor for decorations they will be charged for a similar package/services we provide.

DOWNGRADING: The client may downgrade the package and/or services by contacting Beach Wedding Deals by phone or email. Any Changes to existing products and services will be regarded as a New Agreement and must be in writing before any changes are finalized. The package cannot be downgraded less than 7-days before the event. If you want to downgrade your package, notify us in writing (email) before your final payment is due. We Do Not issue any refunds for Downgrades less than 7-days before your event.

WEATHER: Beach Wedding Deals are Not Responsible for cancellation/postponement of your wedding/event due to acts of God/Force Majeure, unpleasant weather, or any other catastrophe. We strongly encourage the client to have an indoor/covered Rain Contingency Plan (RCP) at an alternate location. The RCP must be near the reserved location and revealed to BWD. We may have another wedding scheduled on the same date/location. Therefore, alternate locations will need to be approved by BWD at the time of, or shortly after booking.

CEREMONY TIME: Beach Wedding Deals has reserved a setup/ceremony for you at a designated time. Another event may be dependent on your wedding starting/ending on time. We understand things happen and allow 30 minutes of flexibility. However, beyond the 30 minutes BWD reserves the right to charge a minimum late fee of $150.00 associated with additional setup time, additional vendor (Photo, Video, Live Musician, Officiant, etc.) costs, and permit fines that may be incurred. Any ceremony/event over 1 hour late may be canceled at the officiant’s discretion with no refund. Late fee must be paid in full before the marriage license is filed or photos released.

MARRIAGE LICENSE: You must provide a Florida Marriage License and valid identification before we perform the ceremony. Except when the ceremony is a vow renewal or symbolic wedding. Please have your marriage license and identification ready for the officiant prior to the start of the ceremony.

PARKING/TRAFFIC: All locations have limited public parking and availability depends upon many conditions. Please plan accordingly for parking and unusual traffic patterns. Some locations have an entrance fee for the day, some are paid by the hour, and plan accordingly for these situations. BWD recommends having your ceremony before 11 a.m. or after 4 p.m. for obvious reasons. If you are going to be in Florida during the week, Monday thru Thursday the beaches are generally less crowded depending on the time of year. Plan on arriving at the designated location a minimum of 30 minutes early. BWD wants you to have a memorable stress-free time in paradise.

WEEKEND RATES: On Saturday's and Sunday's the beaches are generally more crowded, there’s more traffic, and less parking. BWD will charge an additional (min. $250.00) to all wedding packages for weekend rates. BWD strongly recommends avoiding the middle of the day for reasons indicated. BWD cannot guarantee space on a public beach. BWD asks that you remain flexible when space is limited.

CUSTOM LOCATIONS: Custom Locations require additional setup time/preparation and are subject to ‘Custom Location’ costs (Min. $250.00). To cover travel, permits, and all fees associated. Beach Wedding Deals cannot guarantee space on a public beach. BWD asks that you remain flexible when space is limited.

TRAVEL FEE: Due to rising inflation, all weddings in the (Fort Myers Area) under $595.00, excluding Bonita Springs and will be charged an additional $50.00 fee. All weddings in the (Clearwater Area) under $795.00 will be charged an additional $250.00 fee. All weddings in the (St. Augustine Area) under $795.00 will be charged an additional $500.00.

FEDERAL HOLIDAY SERVICES: BWD does not provide regular services on the following Federal Holidays; New Years Eve/Day, Memorial Day, Independence Day, Labor Day, Veteran’s Day, Thanksgiving Day, Easter Sunday, and Christmas Eve/Day. BWD may provide ‘Holiday Services’ for an additional (Min. $250.00) to cover all fees associated.

GENERAL PAYMENT: You may purchase our services in a variety of ways: (1) online self-checkout (2) providing a credit card over the phone (3) a signed agreement/contract which authorizes BWD to charge your credit card (4) by mailing us a certified check or money order made out to Beach Wedding Deals, LLC. By completing the purchase transaction, the client agrees to pay for the services provided by BWD with a valid credit card, cash, or check payment. Depending on the method of online payment/transaction, total package price may include a processing fee of (PayPal 2.6%, Square 2.6%-3.5%) est. current fees.

ENTIRE AGREEMENT This Agreement, including any documents incorporated by reference, shall constitute the entire Agreement between the parties regarding the subject matter hereof and supersede all proposals and prior discussions and writings between the parties with respect thereto.

MODIFICATIONS The parties agree that this agreement cannot be altered, re-written or modified, except in writing, confirmed by email or text by an authorized representative of each party. BWD reserves the right to make policy changes or perform updates to the general terms of agreement.

GOVERNING LAW: This Agreement is governed by the laws of the State of Florida (“Governing Law”), without regard to principles of conflict of laws of any state or jurisdiction. Client hereby agrees that the courts located in Florida (“Place of Jurisdiction”) shall have exclusive jurisdiction over any dispute arising hereunder.

OVERDUE PAYMENT: Client agrees to pay any remaining balance 7 days prior to the wedding date. If the balance isn’t paid before the wedding date, BWD reserves the right to cancel the wedding with No Refund. If the client cannot pay the balance, upon written request (min. 14 days prior to the wedding date), BWD can postpone the wedding once, moving the date/time/location out for up to 1 year without additional cost (except for permits or vendor deposits) until the balance has been paid in full.

SPECIAL EVENTS PERMIT: All special event's permits will be the responsibility of the client to obtain. The client will provide a copy of the permit to BWD before the event's date. Any event can be canceled or postponed for up to 1 year from the original event's date if permits are not obtained prior to the scheduled date.

INCORRECT BILLING: If the client believes Beach Wedding Deals has billed them incorrectly, the client must contact BWD at beachweddingdeals@gmail.com no later than thirty (30) days after the billing date so we can review the issue.

LIMITED LIABILITY: IN NO EVENT SHALL BEACH WEDDING DEALS BE LIABLE TO CLIENT OR ANYONE ELSE FOR DIRECT, INDIRECT DAMAGES, LOST PROFITS, ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR DAMAGES OF ANY KIND WHATSOEVER ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE OR FOR TECHNICAL DIFFICULTIES.

REPRESENTATION AND WARRANTY: Client represents and warrants that: (1) it has authority to enter into this Agreement; (2) entering into this Agreement does not violate any other rights, obligations, regulations, or laws (3) it has obtained all necessary rights for any content that it provides to Beach Wedding Deals use of such content will not be defamatory or harassing or violate any third party rights, including rights of publicity, privacy, and intellectual property rights, or violate any law or regulation.

INDEMNITY: Client agrees to indemnify and hold Beach Wedding Deals and our affiliates, and managers harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising in any manner in whole or in part out of clients use of the site, or its violations of its representations, or warranties/obligations under the Agreement. We reserve the right to make changes to this policy.
